Aidan O’Brien enjoys a burgeoning clinical negligence practice, acting as sole counsel for both Claimants and Defendants in complex multi-million pound claims. He has a Master’s degree in Healthcare Law & Ethics and has been published in the British Medical Journal.
Aidan has a particular specialism in claims arising from obstetric injuries, wrongful birth, cauda equina syndrome and failures in mental health care.
Recent instructions include:
- Claim involving obstetric brachial plexus injury following excessive traction during delivery, which caused the claimant to suffer a right-sided Erb’s Palsy, valued in excess of £3.7 million.
- Claim arising from obstetric hypoxic cerebral insult causing profound disabilities, valued in excess of £3 million.
- Fatal accident claim arising from a suicide arising from a failure to admit and treat a patient with a complex history of pre-existing psychological difficulties.
- Acting for NHS Trust in a claim arising from a ‘never event’ (an event that the NHS defines as so serious it should never occur), where surgeons removed the wrong bone during elective surgery.
- Defending a claim involving allegations that a patient developed Chronic Fatigue Syndrome (myalgic encephalomyelitis) due to the hepatitis B vaccine, pleaded in excess of £6 million.
Aidan is also trained as a Nursing & Midwifery Council case presenter and has significant experience with medical regulatory proceedings.
