Medical Records Collation – Clinco

Any specialist fee earner working in clinical negligence will want to be very careful about where the medical records are sent for collation. Often the collator is the first person to review the records in detail. It’s essential that the records are put in the correct order, with a clear index, right from the start – so that a sound foundation is laid for the issues to be identified and for any later updates to follow easily.
The collator needs the expertise to know when records are missing, and when to refer this back to the fee earner before going any further. Preparing a chronology of events is a skill which requires the collator to assess the relevance of the content of the records to the specific issues on breach and causation.
The case commentary should provide a preliminary assessment of the likely strengths and weaknesses of the case, highlight discrepancies, identify the main issues for the medical experts and pass on any insights gained from the examination of the records. We’re often told we have flagged something the fee earner had not yet seen or considered.
